{"id":12231,"date":"2025-12-05T10:44:02","date_gmt":"2025-12-05T10:44:02","guid":{"rendered":"https:\/\/www.jubi24.com\/?p=12231"},"modified":"2025-12-05T10:44:04","modified_gmt":"2025-12-05T10:44:04","slug":"fcps-opts-to-resolve-students-lawsuit-over-gender-identity-policies","status":"publish","type":"post","link":"https:\/\/www.jubi24.com\/?p=12231","title":{"rendered":"FCPS opts to resolve student\u2019s lawsuit over gender identity policies"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<figure id=\"attachment_338347\" aria-describedby=\"caption-attachment-338347\" style=\"width: 1600px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/www.jubi24.com\/wp-content\/uploads\/2025\/12\/Sign-for-a-girls-restroom-in-a-Fairfax-County-school.jpeg\"><\/a><figcaption id=\"caption-attachment-338347\" class=\"wp-caption-text\">Sign for a girl\u2019s restroom in a Fairfax County school (staff photo by Angela Woolsey)<\/figcaption><\/figure>\n<p>Fairfax County Public Schools has decided to resolve a former student\u2019s lawsuit <a href=\"https:\/\/www.ffxnow.com\/2024\/03\/07\/former-trump-advisors-legal-group-sues-fcps-over-lgbtq-inclusive-policies\/\">challenging<\/a> its policies supporting transgender students before it can reach trial.<\/p>\n<p>The now-graduated student, identified as Jane Doe and represented by the right-wing organization America First Legal, recently accepted the Fairfax County School Board\u2019s offer of a judgment that includes $50 and compensation for legal fees, according to court documents.<\/p>\n<p>Finalized by the U.S. District Court for the Eastern District of Virginia on Monday (Dec. 1), the offer was intended to save both sides from committing \u201clarge resources\u201d to potentially lengthy and costly legal proceedings, Hunton Andrews Kurth attorney Sona Rewari, representing the school board, said in a Nov. 14 letter to Jane Doe\u2019s lawyers.<\/p>\n<p>The school board\u2019s lawyers contended that the $50 judgment \u201cfar exceeds\u201d what the student could expect to win if the lawsuit went to trial.<\/p>\n<p>FCPS affirmed in a statement to FFXnow that its goal in offering to settle the lawsuit was to avoid the cost of a prolonged legal battle and maintained that its policies protecting students from gender-based discrimination are in compliance with state and federal laws:<\/p>\n<blockquote><p>FCPS Title IX policies continue to align with state and federal law. We have agreed to pay $50 and costs, including reasonable legal fees to settle a federal lawsuit claiming violations of free speech and religion. The settlement is not an admission of liability or wrongdoing by FCPS. \u00a0We resolved this dispute for a nominal amount to safeguard public resources and save taxpayers thousands of dollars in legal fees and costs. FCPS remains committed to providing a safe, supportive, and inclusive school environment for all students and staff members, including our transgender and gender-expansive community. Any student who has a need or desire for increased privacy, regardless of the underlying reason, shall continue to be provided with reasonable accommodations.<\/p>\n<\/blockquote>\n<p>Despite FCPS asserting its offer wasn\u2019t an admission of fault, America First Legal <a href=\"https:\/\/aflegal.org\/press-release\/major-victory-america-first-legal-wins-lawsuit-against-fairfax-county-public-schools-for-telling-a-girl-to-share-the-restroom-with-a-boy\/\">trumpeted the judgment<\/a> on Tuesday (Dec. 2) as \u201ca major victory\u201d in its battle to defend students from \u201cradical gender policies.\u201d<\/p>\n<p>The organization, which was co-founded by current White House Homeland Security Advisor Stephen Miller, <a href=\"https:\/\/www.ffxnow.com\/2024\/03\/07\/former-trump-advisors-legal-group-sues-fcps-over-lgbtq-inclusive-policies\/\">alleged in its lawsuit<\/a> that FCPS had discriminated against Doe based on her sex and religion by letting students use restrooms, names and pronouns matching their gender identity.<\/p>\n<p>Initially filed in Fairfax County Circuit Court in March 2024, the complaint stated that, while attending West Springfield High School, Doe felt \u201cunsafe and uncomfortable\u201d sharing bathrooms with a gender-expansive student. She questioned the school\u2019s offer of alternative accommodations, as dictated by its <a href=\"https:\/\/go.boarddocs.com\/vsba\/fairfax\/Board.nsf\/goto?open&amp;id=BU8MW25D2B05\">regulation 2603<\/a>, when they could use both the male and female restrooms.<\/p>\n<p>She also claimed that addressing other students by their chosen names and pronouns would violate her free speech rights and religious beliefs, which hold that \u201cGod creates each person as male or female \u2026 and that rejection of one\u2019s biological sex is a rejection of<br \/>the image of God within that person.\u201d<\/p>\n<p>Though a circuit court judge denied FCPS\u2019 request to dismiss the lawsuit last December, America First Legal <a href=\"https:\/\/aflegal.org\/press-release\/america-first-legal-moves-landmark-fairfax-schools-case-to-federal-court-adding-title-ix-and-federal-constitutional-claims-in-ongoing-fight-for-keeping-men-out-of-girls-bathrooms\/\">re-filed the case<\/a> in federal court on Oct. 3, adding claims that the school policies violate Doe\u2019s Constitutional rights to equal protection and due process as well as Title IX prohibitions on sex-based discrimination.<\/p>\n<p>In a press release, America First Legal President Gene Hamilton characterized the judgment as \u201cjustice\u201d for Doe, who\u2019s now attending college in Nebraska.<\/p>\n<p>\u201cThis judgment is a crucial reminder that no one is above the law,\u201d Hamilton said. \u201cFairfax County attempted repeatedly to block this case, and they failed. America First Legal will not stop defending students whose safety and dignity are threatened.\u201d<\/p>\n<p>The organization noted that its lawsuit was part of a broader national trend of legal and legislative challenges to transgender rights, including a separate case against Loudoun County Public Schools on behalf of two students suspended for <a href=\"https:\/\/www.loudounnow.com\/news\/lcps-states-its-case-in-stone-bridge-locker-room-lawsuit\/article_cc26101a-1d65-4fe4-b0da-a437c2c4735d.html\">allegedly harassing<\/a> a trans student.<\/p>\n<p>FCPS and Arlington Public Schools also remain <a href=\"https:\/\/www.ffxnow.com\/2025\/10\/07\/fcps-seeks-to-speed-up-lawsuit-over-federal-funding-freeze\/\">mired in a court battle<\/a> with the U.S. Department of Education over restrictions imposed on their access to federal funding after they <a href=\"https:\/\/www.ffxnow.com\/2025\/08\/15\/breaking-fcps-rejects-trump-administration-demand-that-it-scrap-trans-inclusive-policies\/\">refused to roll back<\/a> their policies supporting transgender students.<\/p>\n<p>Outgoing Virginia Attorney General Jason Miyares <a href=\"https:\/\/www.arlnow.com\/2025\/12\/01\/miyares-attacks-aps-transgender-policy-in-filing-signed-by-coalition-of-gop-attorneys-general\/\">filed a brief on Nov. 26<\/a> backing the Education Department\u2019s decision, while the NAACP Legal Defense Fund submitted a brief on Monday supporting the school districts\u2019 challenge.
